Ordering:
By ordering through our website you are agreeing to comply with these Terms and Conditions. By purchasing from The Little Things you will be bound to these Terms and Conditions. You may order products from The Little Things by completing and submitting the checkout process on our website. You must provide all of the required information (including name, a working contact phone number, email address, and payment details) or we may not be able to process your order.

Pricing:
All prices are exclusive of delivery costs. Delivery charges are stated on the website, and are added to the order where applicable. The prices for our products are stated and are payable in New Zealand dollars (NZD) only. Prices stated on the website do not include import fees, duties, tariffs, taxes or other imposts or charges which may be payable in relation to your order. You are liable to pay any import fees, duties, taxes, and other imposts or charges which are payable in relation to your order.

Payment Methods:
Paying by Credit Card
(a) All credit card processing will be performed by Paystation. When you select your preferred payment method, accept our Terms and Conditions and click through to the checkout, you will be directed to the third party website for credit card processing. You will be automatically be directed back to The Little Things website when the transaction is complete.
(b) Paystation will process VISA and Mastercard payments
(c) The Little Things does not accept Diners Club, AMEX and Discover.
Information: The Little Things will not process or store any credit card information on its website.

Availability and Cancellation:

Availability:
All orders are subject to the availability of products. If for any reason a product is not available, The Little Things will aim to notify the non-availability on this website. We may revise the range of products or the specification of any product at any time and without notice to you.
Modifications and improvements to our products, prices and data are constantly being made. Although The Little Things has aimed to ensure that the product and pricing information provided on our website is accurate, complete, and current, we do not provide any representations or warranties as to its accuracy, completeness or currency of information, and The Little Things shall not be responsible or liable for any inaccurate, incomplete, or out of date information on the website. We also rely on information from our suppliers and product manufacturers and therefore the descriptions, illustrations and literature are not binding on The Little Things. If the goods do not match the description on our website, you should inform us immediately so that we can take appropriate action if necessary.

Shipping Information:
The Little Things uses Post Haste Couriers for all deliveries within New Zealand where the delivery is required to be couriered and not able to be delivered by us personally.

All New Zealand shipments are tracked via Post Haste Couriers Tracking number system. The tracking number will be held by The Little Things and available to the buyer on request. You can use this tracking number to track your order.

Damages or Loss in Transit:
The Little Things cannot accept any responsibility for goods that are damaged or lost in transit after leaving the business premises.

Refunds:
The Little Things has no warranty available on our products, but will make every attempt to either replace or refund all or part of a product if there is good reason to expect that the product did not live up to your expectations, and that these were reasonable expectations. This will be handled on a case by case basis. Refunds will not be given in the case that you have changed your mind. Any refunds (at our discretion) will be refunded in the form of the original payment method used by the buyer.

Cancellation of Orders:
(a) If products are listed on our website with an incorrect price or incorrect information, you may cancel your order and if you have already made payment for an order that is subsequently cancelled by us, we will refund the amount paid by you in relation to that order.
(b) The Little Things may cancel your order at any time prior to the dispatch or provision of the product.
Any variation, waiver or cancellation of your order by you shall have no effect unless accepted in writing by The Little Things. Where The Little Things accepts cancellation we may request a handling charge of up to 15% of the price.
If we agree on a variation or change to the goods being sold, then this is at the discretion of The Little Things and handled on a case by case basis.
The Little Things may vary the prices on our website at any time and without notice to the buyer.

Purchasing contract:
The Little Things website, the information on it and any information contained in emails are not an express offer to supply products. When you order products from The Little Things, this constitutes an offer from you to buy those products in accordance with these Terms and Conditions. The Little Things acceptance of your order occurs when the goods are dispatched to you. In other words there is no enforceable contract for The Little Things to supply a product until the product is dispatched or supplied to you.

Rejection of orders at our discretion:
No order shall be deemed accepted by The Little Things until it is sent. We reserve the exclusive right to accept or reject (for any reason whatsoever in whole or in part) any order submitted by you, and you acknowledge that we are under no obligation to explain our rejection of an order. If this occurs, any money paid by you in relation to the order or rejected part of that order shall be refunded and we shall have no further liability to you in relation to this issue.
Overseas orders: The Little Things does not have any obligation to send orders overseas, and will only decide to do so at our own discretion.

Warranties:
The Little Things offers no warranty on deliveries
(a) Any quotations of delivery times The Little Things are made in good faith but are estimates and we are not bound by the times quoted.
(b) The Little Things are not be liable for any loss, expense, or other damage caused by any delay in delivery, or by deliveries left at the delivery address specified by you. The Little Things will take reasonable steps to leave products in the best location possible when orders are left at the delivery address, and will advise you of this when possible after the delivery is made.
While you may specify delivery instructions for an order you agree that The Little Things is not liable for any loss, cost or other harm suffered you as a consequence of problems with the delivery.

Risk:
Once your order has been dispatched to the delivery address you assume full responsibility for and risk in the products.

Liability and Maintenance Guarantee:
The Little Things liability to you (whether in contract, tort, or otherwise) for any loss, damage, or injury arising from any defect in, or non-compliance of, a product supplied to you by us shall be limited to the price paid by you for that product.

The Little Things will not be liable (whether in contract, tort, or otherwise) for any loss of profits, or any indirect, incidental, consequential, or economic loss or damage (howsoever caused), which you may directly or indirectly suffer in connection with your access to, use of, or reliance upon, any product or any information supplied to you by us.

Errors or Omissions:
The Little Things is entitled at any time to correct all errors and omissions (whether clerical, computational or otherwise) in any advertising, quotation, invoice or acknowledgement. Due to our administrative processes, errors (if any) may be discovered up to 30 days after the goods have been delivered to you. The Little Things will notify the buyer promptly of any error or omission discovered by us, and give you the option of returning the goods for a full refund.

Ownership:
Ownership of all products sold by The Little Things is retained by us until we have received the full payment for the products and the applicable delivery charges. This provision is designed to protect us in the event of the bankruptcy, receivership or liquidation of The Little Things, a seizure of products by a creditor of you, or default in payment.

Until full payment is made you agree to:
1. Enable the products to be readily identifiable as the property of The Little Things.
2. Maintain the products so supplied in good order and condition and to return the products immediately if called upon to do so by The Little Things.
3. On a sale or other realisation of the products you shall identify and separately account for the proceeds of sale.

Personal Property Securities Act 1999

Until full payment has been received for your order, you acknowledge and agree that:
(a) these Conditions of Use constitute a security agreement for the purposes of section 36 of the Personal Property Securities Act 1999; and
(b) a security interest is taken in all products previously supplied by The Little Things to you (if any) and all goods that will be supplied in the future by The Little Things to you (if any).

You undertake to:
(a) sign any further documents and provide any further information which The Little Things may reasonably require to register a financing statement or financing change statement on the Personal Property Securities Register;
(b) indemnify The Little Things for all expenses incurred in registering a financing statement or financing change request on the Personal Property Securities Register or releasing any item charged thereby;
(c) not register a financing change statement or a change demand on the Personal Property Securities Register without The Little Things prior written consent;
(d) give The Little Things not less than 14 days prior written notice of any proposed change in your name or any of your contact details.
Unless otherwise agreed to in writing by The Little Things, you waive your right to receive a verification statement in accordance with section 148 of the Personal Property Securities Act 1999.

Gift Voucher Terms and Conditions:
Gift Vouchers are non-refundable, not exchangeable for cash, not valid for purchasing further Gift Vouchers and no change will be given. They are valid for 3 months from the date of issue. It is the responsibility of the Gift Voucher holder to redeem it prior to the expiry date as The Little Things is unable to amend the date once a Voucher has been issued.

The Little Things shall not be liable to you for any loss or damage, directly or indirectly arising out of or in connection with any delay in delivery of the goods, or failure to perform any term of a contract for the sale and purchase of products where such delay or failure is outside our reasonable control including without limitation as a consequence of third party action or omission, illness, natural disaster, technical failure or interruption.

Compliance:
You shall be solely responsible for obtaining any necessary permits under (and for compliance with) all legislation, regulations, by-laws and rules that apply to the use of any products purchased from The Little Things.

Changes to these Conditions of Use:
The Little Things reserves the right to change these Terms and Conditions from time to time by publishing the changed terms on our website. When revised Terms and Conditions are published on this website, all orders submitted by you after the revised Terms and Conditions are published shall be subject to the revised Terms and Conditions.

Severability:
If any provision of these Conditions of Use is held to be invalid or unenforceable for any reason, the remaining provisions shall, to the maximum extent possible, remain in full force and effect.

Security:

Protecting your Information:
Credit card payments are made secure by using Secure Sockets Layer (SSL) encryption technology. The Little Things uses this SSL technology to prevent such information from being intercepted and read as it is transmitted over the Internet.

Safe Shopping Guarantee:
By law, a credit card issuer cannot make you liable for charges in excess of NZ$50.00 that result from the unauthorised use of your credit card. Exceptions do apply, and you will have to comply with the rules of your credit card or debit card issuer. We recommend that you contact your card issuer for further details.

Malware:
The Little Things accepts no responsibility for any malware caught from accessing our website. If we determine that you have sought to upload any kind of malware you will be permanently banned and such sanctions as may be permitted by law will be pursued.

Privacy Policy:
The Little Things is 100% committed to protecting our customer’s security and privacy.
We will not pass on any of your details to any third party.

Information Collected by The Little Things:
When you use our site, the site receives and collects certain information. The information that we receive and collect depends on what you do when you visit the website. For most of the browsing services that we provide, The Little Things neither requires nor collects Personal Customer Information. You can browse our website and take as much time as you want to review the our products, services and reviews without having to submit personal information. Even when you use our shopping cart as you browse, there is no need to submit personal information.

Linking to Third-Party Websites:
When you click on links and banners on our site or Facebook page that take you to third party web sites, you will be subject to the third party’s privacy policies. While we support the protection of privacy on the Internet, we cannot be responsible for the actions of any third-party web sites.
You have a right to access personal information held by The Little Things about you and to request correction of any errors.
The Little Things shall retain your personal information for no more than 7 years or as may be required by law.

Disputes and Governing Law:
These Terms and Conditions (and any contracts to which these Terms and Conditions apply) shall be governed by the laws of New Zealand and the courts operating out of Wellington, New Zealand shall have the exclusive jurisdiction to hear and determine any dispute arising in relation to these Terms and Conditions (and any contracts to which these Terms and Conditions apply).
